Obstructed grocery aisle causes hand injury

While walking into a local store of a national grocer, our client was drawn to a fruit stand near the entrance. Having never been to this store before, she looked up at the aisle signs to get her bearings as she left the fruit stand. Unbeknownst to her, a small crate that was about knee-high

While walking into a local store of a national grocer, our client was drawn to a fruit stand near the entrance. Having never been to this store before, she looked up at the aisle signs to get her bearings as she left the fruit stand. Unbeknownst to her, a small crate that was about knee-high was placed against the fruit stand just around the corner of where she was standing. She was unable to see it at all as she walked around the stand, causing her to trip over the crate. While attempting to catch herself as she fell, her hand broke against the floor.

The grocer denied liability altogether, claiming that our client should have had her eyes glued to the floor as she attempted to find her way around the new store. We thought otherwise and filed suit against the grocer in federal court. After presenting the grocer with ample evidence of its liability and the extent of our client’s injuries, we were able to resolve this case early into litigation with minimal interruption in our client’s life for an amount that she believed to be fair.
